Text messages can prove adultery in Alabama courts. However, the court must determine whether the evidence meets foundational requirements before admitting it into the record—and even when they’re admissible, they’re often just one piece of a broader puzzle.

How To Use Text Messages As Evidence In Court

Before a judge allows text messages in the record, they need to answer two questions:

  1. Is this evidence truthful or has it been altered? (Authentication)
  2. Does it matter to the case? (Relevancy)

If you can’t answer both, your evidence gets excluded. This applies to any evidence—photos, emails, financial records, or GPS data.

Text messages complicate things because the only person who truly knows who sent each message is the person who sent them. The court takes neither your word nor your spouse’s. Instead, courts use circumstantial evidence to authenticate electronic communications. By establishing patterns—like a message appearing on the phone bill, matching unique phrases only your spouse would say, or timing that aligns with known affair-related activities—you can create a strong evidence chain.

For example, in United States v. Fluker, the court authenticated emails by showing they came from a board member’s address, contained financial details only he would know, and aligned with the business context of the scheme. Similar reasoning applies to text messages. When a message uses language unique to your spouse, references shared private information, or arrives at times that don’t make sense for anyone else, the combination of these circumstantial markers convinces the court that the message came from the person the evidence is intended to implicate.

Note: Similar authentication standards apply throughout the United States. In Culp v. State, the Alabama appeals court reinforced that electronic evidence must be authenticated through direct testimony and circumstantial factors, including the sender’s identity, contextual relevance, and internal consistency with other evidence in the case.

But beyond simple screenshots, you need to ensure you have preserved the complete digital footprint: call logs, contact information, and metadata that ties the communication to your spouse.

The messages must show who sent it. You must include:

  • The sender’s phone number
  • The contact name in your phone

Without this, the court can’t determine if a text from an unknown number is actually from your spouse.

How to maintain continuity:

  • For each new screenshot, begin with the last line or two of the last message displayed at the bottom of your previous screenshot
  • This visual bridge shows the court you’re presenting the conversation in sequence
  • Avoid starting or ending pages in the middle of a message, which suggests you’re selectively editing to hide inconvenient context
  • Always show full message headers (sender, date, time) on every page

This sequencing proves you have captured the entire discussion, not portions tailored to make a specific point.

Step 5: Demonstrate That The Sender Is The Accused

There’s no guarantee that the messages were sent by the person who owns the phone number. The courts look at specific patterns of behavior and other circumstantial evidence to show who sent the messages.

For example, United States v. Fluker is a case where emails were authenticated through circumstantial evidence: the sender’s email address (which included company initials), content that only the sender would know (specific financial details), and contextual timing that connected the messages to the scheme’s operations. Similarly, when text messages contain unique phrases only your spouse would use, reference private information you share, or demonstrate timing inconsistent with anyone else, the combination of these factors convinces the court of the sender’s identity.

In Culp v. State (Alabama, 2014), emails admitted as evidence satisfied authentication because—among other factors—the sender’s identity was proven through direct testimony and circumstantial evidence (email address, business context, unique content). The appeals court referenced other jurisdictions with similar authentication methods for electronic evidence. Quoted directly from the court’s opinion:

Rather, courts have held that circumstantial evidence establishing that the evidence was what the proponent claimed it to be was sufficient.

What Counts As Illegally Obtained Evidence

It’s essential that any evidence you present is collected legally. Alabama courts strictly enforce the rules governing evidence collection, and violations can lead to the exclusion of entirely relevant material.

O’Daniel v. O’Daniel (1986) involved a wife who recorded telephone conversations between her husband and his alleged paramour. All conversations in their real estate office were recorded as part of their daily business operations. She listened to these recordings, and then recopied conversations between her husband and his mistress to a second tape for the court. The court ruled that these were inadmissible as evidence since they violated federal wiretapping statutes.

Under Title III of the Omnibus Crime Control and Safe Streets Act, conversations can be recorded only if:

  • You’re one of the parties to the conversation, OR
  • One of the parties consents

Likewise, text messages must be carefully collected. Adultery cases are difficult in that you most likely do not have direct access to the text messages between your spouse and their paramour. Instead, you must rely on whatever messages you do have.
